Welcome to The Rad CRM, LLC (“we,” “us,” or “our”). Please carefully review the following Terms and Conditions (“Terms”), which govern your access to and use of our website (“Website”) and software as a service (“Service”) available at https://radcrm.io. By accessing or using our Website and Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or Service.

  1. Scope of Service – The Rad CRM, LLC provides a customer relationship management Service for businesses located in the United States. Our Service allows users to create accounts, manage teams, upload content such as text and images, and access the Service from various locations across the United States. Service details, pricing, and features are available on our Website.
  2. Account Creation and Usage – Users must provide accurate information during registration and are responsible for maintaining the confidentiality of their account credentials. You are liable for all activities that occur under your account. You agree not to share your login credentials or provide access to unauthorized individuals. You must also comply with all applicable laws and refrain from using the Service for any fraudulent, illegal, or unauthorized purposes or any activity that may harm, disrupt, or compromise the Service or other users.
  3. Subscription Plans and Payment – Users are billed according to the selected service plan. Payments are due as specified and are non-refundable, including any and all payments submitted to Rad CRM LLC. Subscription renews monthly unless canceled in accordance with the cancellation terms. Prices are subject to change with prior notice.
  4. Subscription Cancellation
    You may cancel your subscription to The Rad CRM at any time by logging into your account and following the cancellation procedures outlined in your dashboard, or by contacting our support team at [email protected]. All cancellation requests must be submitted at least 72 hours before your next billing date to avoid being charged for the following billing cycle.
    No Partial Refunds
    All payments are non-refundable. Once a payment is processed, we do not offer refunds or credits for partial months of service, downgrade refunds, or unused time within an active subscription period.
    Termination of Service
    Upon cancellation, your access to The Rad CRM platform and associated services will remain active until the end of your current billing cycle. After that, your account will be deactivated and data may be archived or deleted in accordance with our data retention policies. Upon receipt of notice from a client, through any communication channel, of intent to pause or cancel their account, Rad CRM reserves the right to immediately restrict access to the account, including locking folders, assets, and features, or to cancel the account entirely. Such actions may be taken at Rad CRM’s sole discretion and are intended to protect proprietary systems and materials.
    Dispute & Chargeback Policy
    We strongly encourage customers to contact us first with any concerns regarding billing or service before initiating a chargeback. Chargebacks filed without prior communication may result in immediate termination of services and may be considered a violation of these terms. If a chargeback is determined to be unwarranted, we reserve the right to dispute the chargeback and pursue recovery of funds.
  5. Sub Accounts and Client Information – Users may and upload content including sensitive client information. You are solely responsible for the confidentiality and security of such content. The Rad CRM, LLC is not liable for any breaches or unauthorized disclosures of information from your sub accounts. The collection of Social Security Numbers (SSNs), full or partial, is strictly prohibited within our system. This includes, but is not limited to, form submissions, file uploads, text fields, chat messages, email communications, or workflow automations. Our platform is not intended for storing protected personal information of this nature. By using this system, you acknowledge and agree that you will not collect or store SSNs and that any accidental submission will be removed upon discovery.

  7. Respect and Courtesy – We expect all communication with our staff and representatives to be conducted with professionalism, respect, and courtesy. Determination of whether a client’s conduct violates this standard will be made at our sole discretion. We reserve the right to refuse service, suspend, or terminate accounts without refund if, in our opinion, a client engages in disrespectful, abusive, or harassing behavior.
  8. Intellectual Property, Snapshots, and Transfer Restrictions – All software, content, automations, workflows, templates, configurations, and other materials created within or provided through Rad CRM are and shall remain the exclusive property of Rad CRM. Clients receive a limited, non-transferable license to use such materials solely within their active Rad CRM account. No proprietary content or configurations may be copied, reproduced, exported, transferred, or reused in any form. Rad CRM does not provide snapshots, sub-account transfers, or any export of proprietary system materials. Upon cancellation, clients may export only their contact data, and no other portion of the account, assets, or configurations may be transferred or removed. Any violation of these restrictions may result in immediate account termination without refund and may subject the client to additional legal remedies.

A statement of good-faith belief that the disputed use is not authorized.

Ownership of Content and Trademarks – All content, including text, images, trademarks, and other intellectual property displayed on our Website and Service is the exclusive property of The Rad CRM, LLC. You may not use, reproduce, distribute, or modify any content without our prior written consent. You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide, fully paid up license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of any content you upload.
  2. Feedback and Suggestions – We welcome feedback and suggestions regarding our Service. However, any feedback provided is deemed non-confidential and non-proprietary. You grant us a perpetual, irrevocable, worldwide, royalty-free, and fully paid up license to use, reproduce, modify, and distribute such feedback or suggestions without compensation or acknowledgment.
  3. Promotions, Contests, and Sweepstakes – The Rad CRM, LLC does not currently offer promotions, contests, or sweepstakes on our Website or Service.
  4. Goods and Products – Our Service is not intended for the sale or distribution of physical goods or products. The Rad CRM, LLC exclusively offers software as a service (SaaS).

Users may also terminate their account at any time by following the cancellation process defined in their subscription plan. Upon termination, users may lose access to data and services.

Disclaimer of Warranties – The Rad CRM, LLC is provided “as is” without warranties of any kind either express or implied including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

15.Limitation of Liability – The Rad CRM, LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Service. Our total liability shall not exceed the amount paid by the user within the past 12 months prior to the claim.

  • Indemnification – You agree to indemnify, defend, and hold harmless The Rad CRM, LLC, its affiliates, and its personnel from any claims, losses, liabilities, damages, costs, or expenses arising out of or related to your use of the Service or violation of these Terms.
  • Governing Law and Jurisdiction – These Terms and Conditions are governed by the laws of the State of Arizona.
  • Dispute Resolution and Arbitration – All disputes arising out of or relating to these Terms or your use of the Service shall be resolved through binding arbitration in the State of Arizona. If arbitration is deemed inapplicable, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Arizona.
  • Changes to Terms – The Rad CRM. LLC reserves the right to update or revise these Terms at any time. Continued use of the Website or Service following changes constitutes your acceptance of the updated Terms.
  • Public Information – With the exception of information covered by our Privacy Policy, any data or content you submit or provide through the Service may be accessible to the public. It is important for you to recognize that sensitive and confidential information should be safeguarded on your end. Please be aware that we cannot guarantee the privacy or security of electronic communications, including emails and other information transmitted over the Internet or any other network you utilize.

These Terms and Conditions constitute the entire agreement between you and The Rad CRM, LLC regarding your use of our Website and Service. Any failure by us to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
